Unapproved Works

What happens if work does not have Building Control Approval?

If works are complete more than 18 months; no action taken, unless considered to be injurious to health and safety of people in or about the Building. In which case action will be taken under the appropriate legislation.

Examples of possible dangers:

  • Roofspace conversions,
  • Stairs.
  • Escape windows.
  • Fire regulations.
  • Structurally instability.
  • Evidence of damp.
  • Termination of flues.
  • Removal of internal load bearing walls, chimney breasts, etc.

If works are complete less than 18 months from date of completion; legal action taken under "The Building Regulations (N.I.) Order 1979 (AS AMENDED)". Legal action includes:

Notices to open up works.
Contravention notices.
Summons for failure to deposit plans, make good contraventions, etc.

Regularisation Certificates:

For retrospective approval of building work. No legal requirement at present in N. Ireland, but when introduced it will mean,

It will be possible to obtain a retrospective approval for works, which have been carried out with no approval.
A more detailed and comprehensive inspection of the unapproved works.
Larger Fees will be incurred by you as the applicant.
